Discover how a crypto license in the Czech Republic can be a game changer for your project and your clients.
What you need to know in 2025 about the crypto license in Czech Republic
The Czech Republic crypto license is granted by the Czech Ministry of Trade and Industry. The latest European AML directives, applied in the country by decree, apply to virtual assets services providers. Cryptocurrency businesses are considered as a trade in the Czech Republic, and are therefore liable to register as such to get a license to operate.
The VASP license in Czech Republic applies to a vast number of activities: fiat to crypto exchange, crypto to crypto, custodial and remittance of digital assets etc. Unlike most jurisdictions, there is close to no minimum share capital requirement (1 CZK, about 0,04 EUR) to apply for the license.
Crypto is not considered legal tender in the Czech Republic. The country is working with the ambition to make its capital city, Prague, a hub of innovation and development for the blockchain industry. Most notably, a Blockchain Connect Association Czech Alliance has been formed with the concourse of IBM.
Here are 3 key elements you need to remember about the Czech Republic crypto license:
- Granted in the form of a Trade License by the Ministry of Industry and Trade, but subject to the Czech AML laws, which are derived from the European directives;
- Simple and straightforward to obtain, the VASP license in Czech Republic helps you grow trust among clients and institutions, including providers of banking services;
- Crypto activities are legal in the Czech Republic and are covered by a single license regime.
How to obtain the Czech Republic crypto license in 2025 and what is the process
The process to obtain a crypto license in Czech Republic is one of the simplest out there. The timeline is usually about 2 months, not including the opening of accounts for banking services.
Except for a domestic company and legal address, no residency requirements are imposed onto Czech licensed crypto companies. The shareholders and directors of the company do not have to live in the Czech Republic.
As per the AML laws in force in Czech Republic, which are applications by decree of the European AML directives, a VASP in Czech Republic has to appoint an AML Officer, also referred to as ‘contact person’ from the beginning of operations.
The role of the contact person is to communicate with the Financial Analysis Office of the Czech National Bank and report any suspicion of money laundering or terrorism financing : “the obligated person shall designate a specific employee to fulfill the reporting obligation […] and to ensure ongoing contact with the Office” per Section 22 of the AML Act of 2018.
The process to obtain the Czech Republic crypto business license can be broken down as follows:
- Registration of a company with a legal address;
- Gathering all necessary information & documents;
- Compiling the necessary AML and compliance documentation;
- Application to the Czech Ministry of Industry and Trade to receive the crypto license;
- Opening of a corporate account in an EMI (and payment processing services if needed).
To successfully begin the set-up of a crypto project in the Czech Republic, the applicant must meet the following requirements in terms of documents to prepare:
- ID documents of participants (passport, driving license, proof of residency…);
- Description of the business activities;
- Certificate of incorporation;
- AML/KYC policies & procedures;
- Apply for a Crypto authorisation in the Czech Republic.
Different types of crypto licenses in Czech Republic and the covered activities
The Czech Republic crypto license is officially designed in the Trade Act (last amended in 2023) as a Trade License (živnostenského podnikání), whose subject is cryptocurrency business (field 81 “providing services related to a virtual asset” of the Trade Act Annex – “poskytování služeb spojených s virtuálním aktivem”). This can be then understood as a category of the more general Trade Licenses, whose aim is to regulate various bodies of professional activities.
That is to say that cryptocurrency related businesses in the Czech Republic are seen as an activity that does not require (yet) a specialized body for legislation.
It shall however be clear that it still means that AML laws apply to any company engaging in crypto business : clients should be identified when they register for services and the transactions should be monitored and reported in accordance with the company’s internal procedures and the expectations described in the AML Act of 2018.
A Czech licensed crypto company is then allowed to:
- Provide custodial services for its clients;
- Provide the service of exchanging fiat for crypto and reciprocally;
- Provide the service of exchanging crypto assets for other crypto assets;
- Other services related to crypto (request a consultation for more details).
To quote the AML Act: “a person providing services related to virtual currency means a person who, as the subject of his business activity, buys, sells, stores, manages or mediates the purchase or sale of virtual currency for another, or provides other services related to virtual currency.”

The legality of cryptocurrency business in Czech Republic
Czech Republic has adopted a rather liberal position on cryptocurrency business. Virtual assets services have become one of many elements pertaining to the Trade Licensing Act. This regulation is not specific to crypto or to financial services of any kind, but rather of different professional activities, or “trades”. Czech Republic therefore considers crypto businesses as a trade that requires registration.
In simple terms, if one wants to become a Virtual Asset Service Provider in the Czech Republic the specific trade registration as a crypto business has to be achieved and passed.
As one could expect, AML laws follow the standard established by the Financial Action Task Force (FATF) Guidelines. A crypto business in the Czech Republic is therefore liable to implement KYC procedures, as well as the monitoring and reporting of transactions.
Due diligence has to be conducted upon beginning a business relationship with a client. The crypto company is then liable to identify the client (perform KYC/KYB), collecting and analyzing the ID card of the natural person. Identification should happen before the client reaches the transaction value amount of 1,000 EUR.
If this amount reaches 15,000 EUR or the natural person is a politically exposed person (PEP), enhanced due diligence shall be performed.
Finally, any suspicious transaction has to be notified to the Financial Analytical Office by the contact person in the best delays, and no more than 5 calendar days after detection of the suspicious activity.
In that regard, the legality of cryptocurrency business in the Czech Republic is easily understandable. In Czech Republic, any crypto activity is legal if they:
- Follow the FATF AML-KYC standards
- Are properly registered as a crypto business by trade
- Do not provide services relevant to other regulations (e.g. investment services)
The final point is noteworthy, as a Czech VASP will require additional licensing to provide financial activities such as : banking activities, including providers of payment services and issuers of electronic money (holding fiat on behalf of clients).
Basically, any service pertaining to fiat currency only and not related to crypto shall not be operated by a Czech VASP. This includes:
- Payment systems (sending fiat on behalf of clients);
- Forex (exchanging a fiat currency for another).
Finally, in a similar logic, other financial activities such as insurances, investment of third party funds (even in crypto), financial consulting and gambling services are not allowed by the Czech crypto license.
Cryptocurrency regulation in Czech Republic
In the Czech law, as of 2024, no cryptocurrency regulation is specifically targeting digital assets. They are not considered as a legal tender and therefore their trading and issuance are not subject to a dedicated law.
This enabling stance by the Czech National Bank is coherent with the national narrative that the Czech Republic aims to be a pioneering jurisdiction in crypto, with Prague being a capital of the industry, boasting a high number of crypto ATMs in the city and a highly qualified workforce in the IT/blockchain domain.
EU regulations do apply for cryptocurrency businesses registered in the Czech Republic. This includes AML laws but also GDPR (user data protection), MiFiD and other regulations about financial instruments and services, that limits what a Czech company with a crypto license is allowed to do.
Czech Republic Virtual Cryptocurrency Registry
Entering the Czech Republic’s virtual cryptocurrency registry is the gateway to starting a crypto business.
As cryptocurrency businesses in the Czech Republic are liable to undergo registration as conducting a trade, they enter the Trade Registry under the categorization of Virtual Assets Services Providers. VASPs in the Czech Republic are not listed in a public register.
Cryptocurrency activities are listed as a trade in the Czech Republic. A trade is “a systematic activity carried on independently under the conditions laid down in [the Trade Act], under a person’s own name and liability, with a view to making a profit”. Companies registered as crypto businesses are therefore subject to the supervision of the Ministry of Industry and Trade.
The Czech Republic Trade Licensing Register offers assistance to entrepreneurs and companies willing to get a registration. They work in parallel with the Czech National Bank to regulate crypto entities.
Crypto-authorization process in the Czech Republic Virtual Currency Registry
The authorization process to successfully get a business in the Czech Republic virtual currency registry is as simple as it sets. A new project can be up and running in just 2 months, following a straightforward process.
Getting into the details of the process, the key element to get successfully registered is to have properly prepared documents for AML-KYC. In the case of existing and operational companies, existing policies and procedures can be reused, though it is strongly advised to have them checked and adjusted beforehand.
Such a process would also include communication to the regulatory authorities, therefore streamlining the process and optimizing chances of success in having the registration approved.
The registration of Czech Republic Company in Register of crypto currency companies
The process of registration of a Czech Republic company in the Trade Register for crypto currency activities can be broken down into 5 separate steps, as follows:
- Incorporation of a limited liability company in the Czech Republic
- Appointment of a contact person
- Drafting of AML-KYC related documents
- Application to the Trade Register
- Opening of a corporate account in an EMI
The incorporation of a Czech limited company (s.r.o) is always step number one. A crypto business in the Czech Republic shall be either a resident natural person or a Czech registered legal person. A Czech limited company does not require a local director.
Appointing a contact person is usually the critical point of the process. The contact person will be liable to communicate client and transaction information, pertaining to the AML Act of 2018.
Drafting the AML-KYC policies for internal use is required to comply with the AML Act as well. These documents should give a clear understanding of how clients are identified and how their transactions are monitored, in order to report suspicious activity.
Then the application is carried to the Trade Register. Once successful, the company is granted a registration number and a certificate.
The final step of the process is to open a crypto bank account. Usually, Czech crypto businesses are relying on Electronic Money Institutions (EMI) to be provided with banking services.
Governmental Statements on Crypto in Czech Republic
The Czech Government and Governmental Institutions have not issued statements on crypto assets as of 2024.
The Czech Republic is the typical example of a jurisdiction that is pro-crypto and willing to give room to crypto entrepreneurs, while being in a way limited to the freedom it can provide because of supranational rules (EU laws, FATF and OECD standards).
This ensures an empowering framework for crypto businesses to flourish and a high level of trust and protection for clients of these companies.
Importantly, the current framework shall be overhauled by MiCA in the Czech Republic, in the future. MiCA, for Markets in Crypto Assets, is the upcoming European framework. Once this regulation is applied in the Czech Republic, the license shall change accordingly.
Requirements for companies engaged in crypto activities in Czech Republic
Entering the Trade Register of crypto companies in the Czech Republic gives a company the right to operate in the field of digital assets, provided they respect the requirements set by the Czech AML law.
These requirements include:
- The participants shall provide an Apostilled/notarized proof of non-criminal record, along with ID documents;
- The participants have demonstrated competence in the field with their CV;
- Systems and software compliant with the AML laws, for conducting and supervising transactions;
- Internal procedures in line with the AML laws;
- AML policies and training material for participants and employees;
- Staff training at least once every 12 months;
- Appointment of an AML officer and a director, none of which needs to reside in the Czech Republic.
The process of setting up a company for a cryptocurrency business in the Czech Republic
Setting up a limited liability company for a cryptocurrency business in the Czech Republic is very simple. It can be done entirely remotely, through a Power of Attorney.
Usually the formation of a crypto company takes 2-3 weeks in the Czech Republic. The process requires choosing a company name, providing a certified copy of a passport and describing the intended activity.
The applicant will be provided with an incorporation certificate, that is step number one to apply for the crypto license in Czech Republic.
Taxation for cryptocurrency companies in the Czech Republic
The corporate income tax that applies to Czech limited liability companies is 19%. This rate therefore applies to cryptocurrency companies as well.
Payouts distributed by a Czech crypto company in the form of dividends are taxed to the level of 15%. Czech Republic benefits from numerous tax treaties to avoid double taxation. In order to properly sort out tax matters, it is advised to consult a tax lawyer in the residence country of the beneficiary of a dividend payment.
Obligations for crypto companies in the Czech Republic
Any company registered as undertaking crypto business in the Czech Republic, having been entered into the Trade Register as such, is liable to comply with the AML laws in force. It is pretty straightforward, the Czech AML laws being in fact the EU AML directives applied by decree.
In the life of a cryptocurrency business, this means enforcing KYC/KYB when starting a business relationship with a client. It also means implementing AML-CFT measures of monitoring and reporting transactions, depending on thresholds, risk assessments and internal procedures.
For example, it shall be very clear what happens in the case of the following events:
- Alice, from Denmark, makes a few crypto transaction of a couple hundreds euros every month;
- Bob, from Uzbekistan, makes a one time crypto transaction of 50 000 EUR.
Sanctions for violating Czech Republic crypto-business obligations
A cryptocurrency business in the Czech Republic operating without a crypto license is liable to a financial penalty that can go as high as 500,000 CZK (about 20,800 EUR). The participants may also be struck as not being trustworthy and reliable, potentially barring them from applying to the license later on.
It is also important to note for foreign investors that the Czech Republic expects perfect transparency regarding ultimate beneficial owners of companies (UBO). Failure to properly register and disclose the expected information regarding the UBO of a cryptocurrency business can lead to sanctions of up to 500,000 CZK (20,800 EUR approximately) as well as criminal liabilities depending on the case at hand.
