What you need to know about the SVG Forex Exchange license

Until January 2023, Forex brokerage companies were unregulated in SVG. Any LLC (the IBC status in Saint Vincent was deleted in 2018) was free to offer Forex and cryptocurrency brokerage services without the need for a license.

In 2022, the Financial Services Authority of Saint Vincent and the Grenadines (SVGFSA) amended its Money Services Business Act of 2009. The amendment provided detailed descriptions and clarifications of the existing framework related to companies engaged in providing money-related services, including Forex brokers. The main licensing demand remained unchanged: businesses can obtain the SVG Forex license on the condition that they already own an authorized entity in a different jurisdiction. 

Note: if the company operates in a jurisdiction where a license is not necessary to conduct Forex activities, the competent authority in the relevant jurisdiction should issue a letter to the SVGFSA.

SVG Forex license: Process & Timeline

The process and duration of forming a Forex company in Saint Vincent and the Grenadines depends on a few factors.

If the project is starting from scratch, without any existing corporate structure, then one should expect a minimum of 3-4 weeks to create an SVG LLC and obtain a Forex license that would authorize it to operate as an SVG Forex broker.

Legal details of the Forex license in SVG

Saint Vincent and the Grenadines does not issue an official license to Forex companies. It provides them with the benefits of operating from this reputed offshore jurisdiction, provided that they comply with the Memorandum of the SVGFSA issued on January 6th of 2023.

The SVG FX license, therefore, doubles as an offshore Forex license issued by a regulator other than the SVGFSA.
